Fortunately, no epic ending happened, but what will these guys do on the road next time?

But these guys are already older - a grade somewhere in the ninth school. We decided to show off in the parents' car, celebrating the birthday. Mouzon louder - and forward to adventure, filming a gallant act on a smartphone camera. The festive occasion and driving style hint that the driver was unlikely to be sober. The ending is predictable, and at the same time the guys were very lucky that it was just a safety rail, and not a post, pedestrian or “oncoming lane”. It is possible and necessary to instill in children an interest in driving a car and give him the appropriate knowledge, but at the same time one should be aware that this should be an activity, first of all, of an educational nature, and not of a teaching one. For example, in the following video, instructors teach their 8- and 9-year-old children on a covered snow-covered area, but the objectives of such a lesson are dubious: the kinders perform ridiculous slides and senseless “police turns” in relative safety and under adult supervision. But why? There is a danger that the child will feel like a super pilot ahead of schedule and will do things because of this at the beginning of an official driving career. And so that children from an early age know how to feel the car, give them better in karting.

Recall that, in accordance with Federal Law of 10.12.1995 N 196-FZ "On Road Safety", the right to drive vehicles of category "B" is granted to persons who have reached the age of eighteen, and in accordance with Section 21 of the Traffic Rules, training driving on roads is allowed only with a trainer and if the student has initial driving skills (from 16 years old for cars), and the trainer must have with him a document for the right to learn to drive a vehicle of this category, as well as a certificate for the right to drive a vehicle of the corresponding categories. In accordance with the Code of Administrative Offenses, the transfer of control of a vehicle to a person who knowingly does not have the right to drive a vehicle (except for a training ride) or is deprived of such right is punishable by a fine of 30,000 rubles, and driving a vehicle by a driver who does not have a license (except for training driving) shall entail the imposition of a fine of 5,000-15,000 rubles and the detention of the car. Better to spend this money on a driving school.

This vicious practice, when a minor gets behind the wheel of a modern car with the permission of his parents, is not approved by the teachers of driving schools. A car weighing more than a ton cannot be a toy for a child of 7-12 years old, because the movement on some highways reaches speeds of more than 100 km / h. There is no need to teach how to drive a car from such an early age, to "adapt" a child to the difficult conditions of real traffic. Moreover, the parent does not have the right to learn how to drive a car and does not have the necessary pedagogical skills. Such training is, in fact, a crime. Parents who are “innovators” should remember that the presence of a child behind the wheel and the resulting rash step of an accident can have irreversible consequences and cause psychological trauma to a teenager for many years. To adapt to the realities of the road, you can offer the child to start cycling, go-karting, study the rules of the road with him, attend special courses for children, and study at a children's and youth school. Only such a sound parental and pedagogical approach to the study of the Rules of the Road, the acquisition of vehicle driving skills will make it possible to grow a confident and responsible driver from a small person.

According to Eugene, the Renault driver, noticing that he was being filmed, stopped near the Salut cinema.

- There was a child in the passenger seat who was transported without a child seat and without using seat belts. At the same time, the window was completely open in the car, - our reader is outraged.

He claims that he sent a video to the traffic police of the Leninsky district with a request to give a legal assessment of the actions of the Renault driver.

- This fact is being checked. This is a gross violation of traffic rules by the driver. He created a danger both for children in the car and for other road users. In the event of an accident, children could be seriously injured - emphasized Sergey Zaranik.

He recalled that the traffic police requires strict observance of the rules for the transportation of passengers and especially children.

The rules for the carriage of passengers are determined by Chapter 23 of the SDA. In particular, it is indicated how the driver should transport children. Clause 178 states that the transportation of children in a passenger car equipped with seat belts should be carried out using:

  • child restraints corresponding to the weight and height of the child - under the age of five;
  • child restraints corresponding to the weight and height of the child, other means (boosters, special cushions for sitting, additional seats) that allow you to safely fasten a child using the seat belts provided for by the design of the vehicle - at the age of five to twelve years.
  • It is allowed to transport children under the age of twelve years without using the devices specified in part one of this paragraph if the child's height exceeds 150 centimeters, as well as in a taxi car.
  • It is forbidden to transport children in the front seat of a passenger car using child restraints appropriate for the weight and height of the child, the back of which is turned towards the windshield of the vehicle, if the front seat has an airbag, unless the front airbag mechanism is disabled.

In addition, there is clause 181.6, which explicitly prohibits the transport of children on the lap of the driver.
And here's what else an adult must understand, who is responsible for the safety of children. For improper performance of these duties, there may even be criminal liability under Art. 165 of the Criminal Code - "Inadequate performance of duties to ensure the safety of life and health of children."

Administrative arrest in this case does not threaten, since it is not applicable to children. This punishment is regulated by article 12.8 of the Administrative Code, paragraph 3. Additionally, the car owner may lose his license for one and a half to two years. In case of repeated violation, the certificate is taken away for 3 years, and the fine increases to 50 thousand.

If a minor child was drunk while driving, but he took the car keys without asking, then he can get registered with a narcologist, if the Commission on Minors' Affairs so decides. Then it will be much more difficult for him to get a license, since a mark with a narcologist is also required by the medical commission.

  • handing over the steering wheel to a minor if the parents themselves allowed their child to drive - a fine of up to 30,000 rubles. Adults will have to answer under clause 3 of article 12.7.

Legal subtleties and additional penalties

The fact that the offender is a minor can be called a mitigating circumstance when considering a case of a committed offense. The case is carried out with the involvement of the parents or other legal representatives of the child, as well as the prosecutor. Consideration is going on in court at the place of residence of the offender.

What happens if a minor is caught driving a car? The parents are immediately notified that the juvenile offender is detained. When a minor child sits behind the wheel, then, not having a license, he automatically cannot be entered into the CTP policy. This entails another punishment for his parents. As stated in part 2 of article 12.37 of the Administrative Code, the value the fine will be at least 800 rubles.

However, if the driver is under 18, but he has reached the age of sixteen, then the court has every right to bring the teenager to administrative responsibility, since this is permitted by paragraph 1 of Art. 2.3 Administrative Code of the Russian Federation. But even here it may turn out that the Commission on Juvenile Affairs will try to free the teenager from the due administrative responsibility. Then, in accordance with paragraph 2 of Art. 2.3 of the Code of Administrative Offenses of the Russian Federation, compulsory educational measures will be applied to the child who committed this violation.

In addition to the fine for violation of traffic rules by a minor driver, punishment under Art. 5.35 of the Administrative Code of the Russian Federation. This will happen if the traffic police inspector decides to refer the case to the prosecutor's office, where it is considered that the parents do not pay due attention to the upbringing of their child. Despite the fact that it is possible to learn driving in most driving schools from the age of 16, after reaching this age mark, you can only drive a moped (category M) and a motorcycle with an engine capacity of up to 125 cm3 (category A1).
