Such a prohibition is regulated by the Technical Regulations of the Customs Union in its clause 5.5 in their "requirements for vehicles in operation" (Appendix 8 of the regulation). At the same time, this normative act clearly regulates the winter and summer months. The former are December, January and February, the latter are June, July and August.

At the same time, these months may differ if any region of Russia establishes its own rules, which is quite logical; and only in the direction of increase, which ... is completely illogical. Indeed, in the same Krasnodar Territory, winter tires may not be required at all. But alas, this is the law!

5.5. It is prohibited to operate vehicles equipped with tires with anti-skid spikes in the summer period (June, July, August).

Where can I find out about the increase in the ban in my city?

Alas, there is no way to unequivocally answer this question. For 2019, not a single region and city has changed the provisions of the Technical Regulations regarding summer tires in winter.

The technical regulation of the Customs Union "On the safety of wheeled vehicles" regulates that in summer, in particular, in June, July, August, the operation of winter tires (studded) is prohibited. If the tires do not have studded studs, it can be ridden in the summer. At the same time, the law states that you can drive on studded tires until June 1 without changing.

To determine the correct procedure for changing a winter tire to a summer one, it is necessary to determine the exact date. Nobody can name her. However, for the middle zone of the Russian Federation there is a date according to which all car owners are required to ride on winter tires until this date. The time of transition to summer wheels by law is March 15th.

Passenger car regulations

The main provisions of the law that determine the rules for the transition from winter to summer tires in cars are as follows:

  • On January 1, 2015, amendments to the law regarding the term "winter tires" and its detailed meaning came into force. The amended articles refer to the permissible tread depth. However, there is no mention of seasonal tires while traveling in a vehicle;
  • Penalties for a shift are permitted by law if the regulations of Part 1 of Article 12.5 of the Administrative Code of the Russian Federation have been violated. That is, if the current wheels do not comply with the technical regulations, the changes of which are prescribed in the articles. The police inspector may not draw up a protocol, but simply give a verbal warning;
  • A new technical regulation of the law came into force. The conditions prescribed in it apply to summer and winter tires. In summer, you cannot ride on studded tires from June to August, and in winter, in summer from December to February. In accordance with the climatic conditions of the individual regions taken, the shift period can be changed. So far, a fine for such a violation is not envisaged in accordance with the latest legislative provisions.

Therefore, the period for changing from winter tires to summer tires is determined individually, depending on the region and climatic conditions.

The procedure for changing tires for trucks

Changes in the timing of tire change in accordance with the law will affect trucks. Regional authorities independently determine the period during which only one type of wheel can be used. At the same time, experts argue that deadlocks cannot be avoided.

For example, in order for a truck driver to cover the distance from Sochi to Murmansk, he must change from one type to another several times. Legislative experts are proposing changes to the law, which will determine the exact date of tire change.

You should also change the truck tires if they are unsuitable for subsequent use. There is a procedure for determining the indicators of tire change:

  • Jumpers are visible on the tread;
  • An instrument is applied or determined by eye;
  • The depth of the pattern for summer tires should be at least 1.6 millimeters, for winter tires - at least 4 millimeters;
  • The amount of wear on a studded rubber is determined by the number of studs remaining.

If at least one of the above requirements does not comply with the norms of the law, the tires on trucks must be changed.

Terms of wheel replacement by law

In 2017, a bill was passed. Now car owners are obliged to change their wheels at the strictly allotted time - December 1. But if a tire change has already been carried out before that date, this is not considered a violation of the law. You can move on a winter tread until March 1. Upon its occurrence, the vehicle can be changed. However, in some regions of Russia, it is recommended to change your shoes on March 1 or later. By this number, weather conditions become more resistant to changes.

Penalties

It should be noted that there are no penalties for summer tires. This provision is absent in the Federal Law. Therefore, rumors that punishment is imposed for an untimely shift are refuted.

They also point out that even all-season tires may not always be suitable for difficult winter conditions.

In summer, according to Continental, winter tires wear out faster, impair vehicle handling and braking distances, and increase fuel consumption.

Experts recommend changing tires after five years of use, regardless of wear and tear. The maximum service life of a tire is ten years, even if it has been in the spare wheel well all this time. You can increase the life of your tires by regularly checking the air pressure in them, monitoring wear and adjusting the wheel alignment if necessary. You should also run in new studded tires for 500 kilometers, and Velcro - for 300 kilometers.

Are there any problems

There is a sufficient supply of winter tires for passenger cars and light commercial vehicles on the market.

For example, a set of four winter tires with spikes 175/65 R14 for Lada Kalina will cost from 7 to 16 thousand rubles, and 225/75 R16 for UAZ Patriot - from 21 to 38.5 thousand rubles, depending on the manufacturer.

“As for trucks, here tire manufacturers consider it premature to require winter tires to be installed on all axles of commercial vehicles and are in favor of phasing,” Churmeeva said, explaining that this is due to the readiness of the tire industry and the additional economic burden on truck owners.

Until changes are made to the traffic rules, the discussed amendments to the Code of Administrative Offenses will only apply to the requirements for the tread depth of winter tires, but not to the requirement for seasonal tire change, the Association of Tire Manufacturers said.

○ Why don't car enthusiasts change tires?

Russians are known for their thirst for fast driving, while not always safe. One such risk is associated with out-of-season rubber use. This happens for various reasons. Some are forced to save by the crisis, others do not want to stand in the seasonal queues of tire shops, others simply do not plan to install a new set, being ready to throw out the old one.

Whatever reasons prompted you to leave the tires out of season, plus there can be only one, and that is very conditional - saving on tire fitting services. There will be much more cons, including material ones.

The first and most important disadvantage of rubber out of season is a decrease in the controllability of the car, and therefore the safety of the driver and passengers. In the first spring sun, the already soft winter tires begin to warm up from the warm asphalt. The rubber becomes viscous, and the controllability of the car decreases, with sharp braking, the car will easily drag forward, the consequences can be very unpleasant.

Stiffer summer tires in winter give lower grip and the car simply "carries" on the road, which in itself is not safe.

The second problem is increased wear. GOST the minimum tread height of a passenger car has been set at 1.6 mm, but it is not worth reaching that point when buying a new set already 2 mm. Using rubber out of season will bring your purchase costs closer.

With proper use, a set of rubber will last up to three years, but if you do not change it, then the wear rate will increase on average three times. Studded tires serve well in the cold season, but with the establishment of heat and complete clearing of the asphalt from ice, the spikes simply fly out of it, forcing you to buy a new set for the next season. In addition, on a summer road, the studs lengthen the braking distance, creating a risk of accidents. But even studless winter tires, warmed up by the summer sun from their softness, wear out three times faster.

The reasons why you shouldn't skimp on rubber replacement are clear, so when is the time to do it?

○ Terms of transition to winter and summer tires.

Let's start with the fact that at the moment in Russia there is no full-fledged law that has come into force, obliging to change rubber as such, or setting the timing of such a replacement. In the USA and Finland, the change dates are fixed. If the inspector notices the car “shod out of season”, the driver will be fined.

In Russia, there is a technical regulation on the safety of wheeled vehicles, which prohibits the use of:

  • Studded winter tires in June, July and August.
  • Summer tires on any vehicle wheel in December, January and February.

Of course, these are not exhaustive rules and it is imperative to focus on the climatic conditions of a particular region. Experts advise to install summer tires no earlier than the temperature above +5 ° C / +7 ° C. Before that, there may be night frosts, after which morning frost on the roads is possible. Usually it is March 10-15, but in the Crimea and Krasnodar Territory on March 1, spring is in full swing, and in the Magadan region they will hear about it only by April. This is one of the reasons why the law "On safety of vehicles" regulating tire change is still not fully operational, it is necessary to take into account regional specificities. At the moment, it contains a ban on the use of winter studded tires from May 1 to September 30, and summer tires from December 1 to March 1. Non-studded winter tires can be left on for the whole year.

As for winter tires, experts do not recommend delaying the change of more than 15 November. According to statistics, by this time in most regions of the country there is already a high probability of precipitation in the form of snow or ice.

The law does not prohibit all-season rubber, but when using it, it is important to take into account the climatic factor, at too low temperatures it will not be stable enough, and in too hot summer it will become too soft. In addition, it must be marked "M + S", "M&S" or "M S"

○ Penalty for riding winter tires in summer.

Administrative Code does not contain an article indicating a fine for using winter tires in summer, but the possibility of its introduction is already being discussed. The most probable amount of the fine at the moment is 500 rubles. But even in the future, only the use of studded tires will be held liable.

But already now, the traffic police inspector has the right to draw up a report if he finds increased tread wear on your car or winter and summer tires on the same axle.

On the Internet, once again, a rumor quickly gained popularity stating that from November 1 of this year, all cars must necessarily. And once again, this rumor did not have a legal basis.

Can you ride summer tires?

No direct APPLICABLE laws, applications, regulations requiring drivers to switch to winter tires on a mandatory basis from November 1 of this year were not adopted. Everything exists at the moment only in the form of a bill. Therefore, employees of the traffic police or the Technical Supervision are not entitled to check and fine for unrefused tires. Moreover, a system has not yet been worked out according to which control by the traffic police or the Technical Supervision authorities will be carried out. It is not known how preventive measures, raids will take place, staff training has not been carried out, and much more. In other words, the technical regulations have been adopted, but the regulatory framework for it is not yet ready.

It is also unknown what fines will be applied to motorists who do not have time. The department should publish the exact information closer to December.

According to the current article 12.5 of the Code of Administrative Offenses of the Russian Federation, a fine of 500 rubles, according to the current rules (Basic Provisions for Admitting Vehicles to Operation), can be obtained only for the use of worn-out rubber (it does not matter, summer or winter), but not for its inappropriateness to the season.

Remember that any driver should be guided, first of all, only by the current traffic rules, for violations of which a certain responsibility is prescribed at the legislative level. In the case of using rubber out of season, in the current, and accordingly in the current Code of Administrative Offenses of the Russian Federation, there is not a word about this. This only means that drivers and vehicle owners can change tires as they see fit.

As before, the general terms of using winter tires established by the "Technical Regulations on the Safety of Wheeled Vehicles" are calculated from December to February. And most importantly, the "Basic Provisions for the Admission of Vehicles to Operation" does not contain a ban on the use of summer tires in winter. Therefore, it is now impossible to bring the driver to responsibility under Article 12.5 Part 1.

According to available data, the period from December 1 to March 1 will be the same for all regions of the country, in which. Also, the regions will be given the right to independently establish the terms of use of winter tires, changing this period upward.

As a reminder, on January 1, 2015, a new technical regulation "On the safety of wheeled vehicles" came into force. It says:
